MAJORITY OPINION.—The Department of Justice, on the behalf of the Department of Defense requested the Gambino family be added, as a group, to the Ban on Sight and National Punishment lists.
This court finds that the Gambino Family, as led by VincenzoGambino, is guilty of terrorism as defined under Part 2, Section 1(1) of the Defense Act 2025, as a group who has threatened to raid the White House headquarters with bots. VincenzoGambino’s threats were made in his capacity as the leader of the Gambino Family, implicating thus the entire family in this terrorist threat.
This court further finds that the Department of Defense must adhere more strictly to the protocols and procedures as demanded by the Defense Act 2025 moving forward, issuing a strict warning to do so, indicating the following points of concern:
(1) The Department of Defense did not request the approval of the appropriate National Security Council members in a website message, including therein the Department of Justice.
(2) The Department of Defense carried out an approval vote over Discord, where the Attorney General was not included, despite being a statutory member of the National Security Council.
(3) The approval, having been granted on October 1st, was not transmitted to the Attorney General until October 10th.
WHEREFORE.—The Secretary of Defense is hereby authorized to issue secondary legislation to facilitate the permanent addition of the group Gambino Family, as led by VincenzoGambino, to both the Ban on Sight and National Punishment lists.
SO ORDERED.—Associate Justice .Martin delivered the opinion, in which Senior Associate Justices Inconclusive- and Brokyy_ joined.
