MAJORITY OPINION.—The Vice President, against whom case SC-128 was accepted by the Department of Justice, whereupon an impeachment resolution was submitted to Congress, issued a piece of secondary legislation (#287 – Code of Conduct (Uniform Waiver 2) Order 2026). Part 8, Section 6(2)(4) of the Prosecution Act 2025 limits the President and Vice President from "issuing orders" upon the Department of Justice accepting an impeachment case against them. The Vice President did not at the time then legally have the power to issue said order. WHEREFORE.—The Code of Conduct (Uniform Waiver 2) Order 2026 is hereby declared INAVLID OF PARENT in its entirety, and is thus UNCONSTITUTIONAL and shall not take effect.
